On September 13, 2021 was held a regular meeting of the working group on patronage, which directs activities to develop and improve the legal regulation of patronage in the culture area.
The agenda of the working group included key and problematic issues in the sphere, in particular critical issues expressed by cultural institutions and patrons, considered the proposals of the Ukrainian Cultural Foundation on the provisions of the law on patronage in the cultural field.
According to the results of the working group meeting, the main procedures and sequence of directions, the algorithm of further actions and key stakeholders of this process were determined. In particular, in the normative direction to begin work on the development and amendment of the Law of Ukraine “On Culture”, in close cooperation with the Parliament Committee on Humanitarian and Information Policy.
The meeting was attended by members of public councils at the Committee on Humanitarian and Information Policy of the Verkhovna Rada of Ukraine and the Kyiv City State Administration, which are the initiators of such cooperation, and representatives of leading cultural institutions of Ukraine.
Specialists from the Ministry of Culture and Information Policy of Ukraine also joined the meeting. The Ministry’s participation in this working group is due to the great public interest in updating the legislation on charitable activities.

The Ukrainian Media League systematically emphasizes that such areas as science, education and culture are the most dynamic in their development, systematically acquire new forms and meanings, and therefore, limited regulation of patronage is an unconditional risk of narrowing opportunities to engage the proactive public and provide assistance and assistance.
UML draws attention to the fact that making changes to various legal acts without a thorough development of a unified conceptual approach, can lead to over-regulation of the group of legal relations. In addition, in this case there are significant risks of opacity and ambiguity of both state regulation (including reporting, customs and tax) and the legal regime of providing / receiving patronage as a separate type of non-repayable investment in development, contribute to corruption risks or disproportionate fundraising. or state aid in certain areas.
Ukrainian Media League will continue its activities aimed at analyzing best practices and global benchmarks, developing regulations and materials in order to unify the provisions on patronage in current legislation and bring it into line with international law, as well as minimize legislative and substantive gaps in existing legal relations.
