  1. General 

1.1.  If you intend to use this site (further – Site) and/or its applications, including RSS, API, software and other files, you agree to comply with all conditions set forth in these Terms of Use of the Site (further – the Rules),  including by registering your account on the Site (account, regardless of its type).

These Rules are a legally binding agreement between the user and the Ukrainian Media League (further – UML or We), the subject of which is to provide the user with services for the use of the Site, its services and content.

1.2.  UML may change, add or remove the provisions of these Rules at any time.  Such changes take effect immediately after publication, without the need for additional information.  You must review these Terms before each use of the Site.  In the event of any changes or agreements, you automatically agree to any changes by continuing to use this Site.

1.3.  You must read these Rules before each use of the Site.  If any provision of these Rules or any accepted changes are unacceptable to you, you can directly indicate this by e-mail: info@medialeague.com.ua and stop its further use, or do not start using it at all.  Your continued use of the Site following circumstances of inadmissibility or after making any changes to the Rules expressly implies your agreement to those circumstances and the Rules, including changes thereto.

1.4.  We may modify, suspend or terminate access to the Site at any time, including the availability of any information, database or content.  We may also impose restrictions on certain features or restrict your access to part or all of the Site without notice, explanation or other obligation.

  1. Use of the content of the Site

2.1.  The materials published on the Site are intended solely for your personal non-commercial use.  All materials published on the Site (including, but not limited to: news, draft photographs, images, illustrations, audio and video content, etc.) are protected by copyright and are owned or controlled by UML or the supplier  content.  You must comply with any additional copyright notices, information or restrictions contained on any page of the Site.

2.2.  The content of the Site is protected by copyright and intellectual property rights in accordance with the laws of Ukraine and international intellectual property law.  You may not modify, publish, transmit, participate in the transfer or sale, reproduce (except as provided in paragraphs 2.3, 2.4 and 2.5 of these Terms of Service), create new works, distribute, perform, or in any way  use the content of the Site (including software) in whole or in part.

Commercial (brand) names, trademarks, etc. UML or third parties are protected by copyright.  Nothing in these Rules shall be construed as granting, indirectly, by default or otherwise, any license or right to use the trademark, patent, design rights or copyrights of the Company or third parties.

2.3.  You may download or copy the content of the Site, other components and elements displayed on the Site for personal use only, provided that all copyright and other communications contained therein are complied with.  Copying or storing any content other than for personal use is strictly prohibited without the prior written consent of the Company.

2.4.  Online publications, mobile applications are allowed to use the information posted on the Site free of charge, provided that the hyperlink and reference to the original source is not lower than the first paragraph and no more than one and a half thousand characters of the original text.  The use of a larger volume of text is possible only with the written permission of UML.

For SmartTV, the use of UML materials is allowed on a paid basis and only with the written consent of the Company.  Other types of media (or media) are allowed to use the information posted on the Site, provided that the link to the original source and provided that the link to the original source.  The use of a larger amount of text is possible only with the written permission of the Company.

The use of information means any reproduction, publication, distribution, processing, translation, inclusion of its parts in other works and other methods provided by the Law of Ukraine “On Copyright and Related Rights”.

2.5.  The company gives written permission to use its materials to third parties at its discretion on the basis of an application sent electronically to info@medialeague.com.ua, with the obligatory indication of the return postal address.  The company reserves the right to request from third parties in the process of consideration of the application any additional information necessary to make a decision on the issuance of written permission.  The use of UML materials is possible only after a third party has received written permission.

2.6.  The use of the materials of the Site by their full or partial reproduction by news aggregators is allowed only with the written permission of UML.  “News aggregators” should be understood as any software, application, service or web resource that uses RSS feeds or otherwise to collect the content of information resources and partially or completely reproduces them for users in the form of blocks, streams, tapes.  ”News, etc.  UML gives written permission for the use of its materials at its discretion to the owner of the news aggregator on the basis of his application, sent in electronic form to info@medialeague.com.ua.

UML reserves the right to request from the owner of the news aggregator any additional information necessary for the decision to issue a written permission in the process of consideration of the application.  The use of UML materials is possible only after obtaining the appropriate written permission, which can be sent to the postal address of the owner of the news aggregator or in electronic form to his e-mail address.  Written permission may apply to individual material (materials) or to all current and future materials on the Site, and is valid for the period specified therein.

  1. User-generated content

3.1.  You agree to use the Site solely for lawful purposes and in a manner that does not infringe the rights of others, restrict or impede others’ access to and/or unimpeded use of the Site.

3.2.  You may not upload, distribute or publish content of any defamatory, offensive, obscene, pornographic, erotic or other illegal material;  advertising events, commercial messages, as well as messages that do not have an information load and do not relate to the subject of the resource.

3.3.  You agree not to threaten or insult other users by using defamation or to knowingly post messages with repetitive content (spam).  Use respectful language.  You agree not to use language that is abusive or discriminating on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc.  Hostility of any kind is grounds for immediate suspension of access to all or part of the Site.

3.4.  The site offers active discussions and welcomes heated debates, but a personal attack is a direct violation of the terms of use of the Site and this is a reason to immediately suspend full or partial access to the entire Site.

3.5.  It is not desirable to disclose in your messages any personal information about yourself or anyone else (for example: phone number, home address, e-mail address, etc.).

3.6.  The materials of the site should be used only in non-commercial form and without the purpose of making a profit.  You may not, without the approval of UML, distribute or cover any ambiguous content, advertising, commercial communications, etc.

3.7.  By using the Site, you acknowledge that any material is distributed by you, (for example, content created by users, including but not limited to: comments, forums, messages, reviews, text, video, audio and photos, as well as computers.  user code and applications) may be removed or modified by the Company.  You waive any rights you may have if such material is available on the Site, and changes to the materials may be made even if you do not agree.  Materials can also be included in our RSS feeds, APIs, and available for reprint through other formats.

3.8. You grant UML, a perpetual, non-exclusive, royalty-free, worldwide license to the materials you post, including the unrestricted right of UML or any third party to use, copy, transmit, publish, distribute, create derivative works, modify  and adapt the index, cache, tags, encoding, (including without limitation the right to adapt to streaming, transmission, mobile, digital scanning or other technology) in any form or media known or subsequently developed, including  including any publications posted by you on the Site.

3.9.  You are solely responsible for the content of your publications. UML does not and cannot control all material and is not responsible for the content of these messages, UML reserves the right to delete, move or edit publications that UML, in its sole discretion, deems offensive, defamatory, obscene, infringement of copyright and trademarks.  characters, or unacceptable.

3.10. You consent to the display and publication on the Site of the material developed by you, as well as for offline advertising purposes.

  1. Access and availability of services

4.1.  Materials may contain links to other World Wide Web Web sites, resources, and advertisers.  As we are not responsible for the availability of these external resources or their content, you should send any concerns regarding any external link to info@medialeague.com.ua.

  1. Statements and Warranties

5.1.  You represent, warrant and promise that materials of any kind submitted through your account: will not be infringed, plagiarized or infringe the rights of third parties, including copyright, trade names, marks on goods and services, other intellectual property,  privacy or other personal or property rights;  contain slander or other illegal material;  and you are at least sixteen years old.

5.2.  The Company does not guarantee or confirm the accuracy or reliability of any advice, opinions, statements or other information downloaded or distributed through the accounts of any users, information providers or any other individuals or legal entities.  You acknowledge and understand that reliance on such opinions, advice, statements, memoranda, or other information should be at your own risk.  The materials of the Site are distributed “as is”, without any guarantees, including guarantees of ownership or suitability for specific purposes.  By doing so, you acknowledge that you are using the Site at your own risk.

5.3.  You warrant that you will indemnify, protect and protect UML and all officials, directors, owners, agents, information providers, affiliates, licensors and licensees from any liability and costs, including legal costs incurred in connection with  with any claim that is caused by a violation of these Rules, warranties and agreements by you or any user of your account.  You must cooperate wisely in defending any such claim.  UML reserves the right, at its own expense, to assume the exclusive protection and control of any matter that requires compensation from you.

5.4.  Materials with dies “advertising”, “company news”, “press release”, “topical”, “point of view”, “official”, “partner material” are published on a commercial or partner basis.

  1. Registration and security

6.1.  As part of the sign-up or account creation process, you will create a login account by selecting a password and providing an email address.  You must also provide us with certain information about yourself that must be accurate and up to date.

Each registration for one user.  You cannot share your login credentials without anyone else accessing your account.  We may revoke or suspend your access to the site if you share your login credentials.  You are responsible for maintaining the confidentiality of the password, which you must not disclose to any UML representative.

6.2.  You cannot:

– choose or use the credentials of another person in order to impersonate that person;

– use account data without the permission of the owner;

– use credentials, in its sole discretion, if they are or are considered offensive.

Failure to comply with the above provisions is considered a violation of the Rules, which may lead to the immediate termination of your account.

6.3.  UML welcomes the participation of persons of any citizenship, gender or other.  features on the Site, including  age, but in order to protect children – persons under the age of majority may not register on the Site.

6.4.  You must notify us of any known or suspected unauthorized use of your account, or any known or suspected security breach, including loss, theft or unauthorized disclosure of your password to info@medialeague.com.  ua.

6.5.  You are responsible for any use or activity on your account on the Site, including the use of the account by third parties with your permission.  Any fraudulent, abusive or other illegal activity may be grounds for terminating your account, in its sole discretion, and We may send the information to the appropriate law enforcement agencies.

  1. Communication between UML and users

7.1.  If you fill out the registration form in order to obtain certain information, UML in general, the founders and successors, with the permission of certain third-party suppliers, we will provide you with information about the materials published on the Sites.

7.2.  You provide, and UML reserves the right to send to your e-mail information about changes or additions to the service on the Site.

7.3.  UML reserves the right to disclose information about usage and demographics, provided that it does not disclose your identity.  Advertisers on the Site may collect and distribute personal information about you only if you confirm your consent in accordance with the UML Privacy and Personal Data Protection Policy.

7.4.  UML may contact you by e-mail about your participation in the user survey, asking questions in order to improve current or future materials, or making newsletters, including about UML’s activities.  This information will be used to improve the performance of the sites and to better understand our users.  Any information we receive in such surveys will not be passed on to third parties, except for generalized impersonal data.

  1. Licenses and software

8.1.  You have no rights to the proprietary software and accompanying documentation, or to any improvements or changes to them (the “Software”), unless you have access to the Site.  You may not sublicense, assign or transfer any licenses granted by UML and the Site, and any attempt to sublicense, assign or transfer such information shall be deemed invalid or unlawful.  You may make one copy of such software for archival purposes.  You may not copy, distribute, modify, rework, or create derivative works of the Software.

  1. Termination of access to the site

9.1.  You can terminate the account at any time by sending an e-mail to info@medialeague.com.ua.  You will receive an automatic email confirmation that your account deletion request has been accepted and your access will be terminated within 24 hours.

9.2.  UML may, in its sole discretion, remove or suspend access to all or part of the Site for any reason, including violation or non-compliance with these Rules.

  1. Miscellaneous

10.1.  These Rules are applied in accordance with the legislation of Ukraine, including the practice of law enforcement and interpretation.  Any disputes concerning the implementation of these Rules will be resolved by the relevant court, in the manner prescribed by current legislation of Ukraine and on the territory of Ukraine.

10.2.  Notwithstanding any of the foregoing, nothing in these Rules may be used to interpret the provisions set forth in the Privacy Policy.

10.3.  Correspondence should be carried out by e-mail info@medialeague.com.ua.

10.4.  You agree to immediately notify us of any copyright or intellectual property infringement of the Company’s materials.  In case of any claims on your part regarding the violation of these rights in relation to the materials contained on the Site, immediately report to the e-mail address info@medialeague.com.ua.
